This agreement is made between any person buying services or products via the Site (the “Client”) and Be Smart In Paris the (“Provider”) registered at the micro-enterprise Registry held by the INSEE under SIRET number 429 970 637 00020 VAT not applicable. Art. 293 B of the General Tax Code - Member of a micro-enterprise tax regime

1. Product Validity:

Services and products are valid as per the dates displayed on the description pages.

2. Prices:

Prices are per person, unless otherwise specified. Prices are in Euros and subject to change without prior notice until a booking has been confirmed.

3. Booking Arrangements:

In all booking arrangements, the person making the booking shall be deemed to have accepted the booking conditions on behalf of the persons named in the booking. No variation to these Terms of Use shall be of any effect unless made in writing by and with the authority of Be Smart In Paris.

Be Smart in Paris reserves the right to cancel, change or substitute any service and to decline to accept or retain any tour members at any time for any reason.

4. Payment:

Credit cards accepted: Mastercard, Visa and American Express.

Full payment by credit card is required to make a reservation. Payment will be listed as Be Smart in Paris on the credit card statement.

If the Client fails to make payment in full for the services before the agreed date by which the services are due to be provided, Be Smart in Paris reserves the right to cancel such services..

Payments are via our secure on-line server in accordance with the price list posted on the Site and depending on the services chosen by the Client. For alternative means of payment, the Client shall contact Be Smart in Paris by sending an e-mail to booking@besmartinparis.com for prior authorization. If the Client books services with less than five days’ notice, payment for such services shall only be accepted on-line.

The Client is then responsible for printing the voucher on its own printer, for subsequent presentation to the Provider in order to receive the Service purchased: the voucher will be sent to the Client by e-mail once the reservation has been confirmed and payment has been received.

5. Cancellation

In accordance with Articles L121-19 and L121-20 of the French Consumer Code, please be advised that you have a period of seven calendar days, from the date of your subscription, to exercise your right to cancel your booking, without penalty and without any cause. However, and according to the article L121-20-2-1 of the French Code of the Consumption, the right of retraction may no longer be exercised once you have accessed the services.

If the 7 day period expires on a Saturday, Sunday or public holiday, it is increased just until the next working day.

6. Amendments:

All requests for amendments to the booking must be directed to the Be Smart in Paris Customer Service Department, for the attention of Christine Polini who will implement the request. E-mail address: contact@besmartinparis.com

7. Refunds:

7.1. Prior to the Services - please refer to the cancellation fees listed in Section 8 below.

7.2. After and during the Tour - No refunds shall be payable once a tour is started.

8. Cancellation Charges:

8.1 Canceling a booking with Be Smart in Paris may result in cancellation fees being applied. Be Smart in Paris will charge cancellation fees as stated below in Section 8.2 When cancelling a booking, you will be notified via e-mail or by telephone of the total cancellation fees payable.

8.2 Tours

8.2.1 80% of the total price will be refunded in case of a cancellation occurring more than 15 days prior to the Tour Date.

8.2.2 Within 14 to 4 days of the date of your tour, the cancellation fee payable shall be 50% of the total amount paid.

8.2.3 Within 3 to 0 day of the date of your tour, the cancellation fee payable shall be 100% of the total amount paid.

8.2.4 Be Smart in Paris strongly advises its clients to wear comfortable clothing and shoes for walking tours.

9. Our Responsibility:

Our clients, acknowledge by their acceptance of these terms and conditions, that Be Smart in Paris shall not be liable for injury, damage, loss, accident, delay or irregularity, liability or expense to person or property due to act of default by any person providing services included in tours in connection with the itineraries of individual tour clients.

Be Smart In Paris, accepts no responsibility for any sickness, pickpockets, strikes, government restrains, theft, acts of terrorism, weather conditions, museum closures, defect in any vehicle of transportation or for any misadventure or casualty or any other causes beyond its control.

Be Smart in Paris does not accept persons under 18 years of age unless they are accompanied with an adult. Persons under the age of shall be under the sole responsibility and the supervision of their parent(s) or accompanying adult during the tour.

For the wellbeing of all customers, the management reserves the right to deny admission to any individuals who might threaten your tour in any way, at any time.

10. Vouchers

10.1 Be Smart in Paris Gift Vouchers are printed and posted to Giftee.

10.1.2 Be Smart in Paris Gift Vouchers cannot be redeemed as cash.

101.3 Be Smart in Paris Gift Vouchers are non-transferable shall only be valid for use by the person nominated by Be Smart in Paris and shall remain valid for 12 months starting from the date of purchase.

10.1.4 A record of purchase shall be retained by Be Smart in Paris.

11. Not Included: transportation, taxi, tips and meals.

12. Insurance:

Be Smart In Paris recommends that you travel with the appropriate travel, medical or other insurance.

13. Data Confidentiality

Be Smart In Paris respects your right to privacy and has complied with the relevant Data Protection registrations. You have a right of access, rectification and deletion of your data under French Law. You can exercise this right by writing to the following address: contact@besmartinparis.com We use the information you have provided for our various Services. All precautions have been taken to archive your data in a secure environment.

None of the information you enter and that relates to you will be communicated to a third party, neither sold nor exchanged. You can modify at any time or delete all your information directly by sending an e-mail to the following address: contact@besmartinparis.com. Due to the nature of websites, some non-personal data may be collected by your browser (Netscape, Internet Explorer, etc.), operating system (Windows, Mac, Linux, etc.) and IP address.

13.1 Internet e-mail

Messages sent over the Internet cannot be guaranteed to be completely secure as they are subject to possible interception or loss or possible alteration. We are not responsible for them and will not be liable to you or anyone else for any damages or otherwise in connection with any message sent by you to Be Smart In Paris or any message sent by Be Smart In Paris to you over the Internet.

13.2 Hypertext links

The creation of any hypertext links whatsoever to the webiste www.besmartinparis.com shall be subject to the prior written consent of the Editor Where we provide hypertext links to other locations on the Internet, we do so for information purposes only. We are not responsible for the content of any other websites or pages linked to or linking to this Site. We have not verified the content of any such websites. Following links to any other websites or pages shall be at your own risk and we shall not be responsible or liable for any damages or in other way in connection with linking. Links to downloadable software sites are for convenience only and we are not responsible or liable for any difficulties or consequences associated with downloading the software. Use of any downloaded software is governed by the terms of the license agreement, if any, which accompanies or is provided with the software.

No endorsement or approval of any third parties or their advice, opinions, information, products or services is expressed or implied by any information on our Site.

13.3 Dysfunction and viruses

We do not represent or warrant that the Site will be available and meet your requirements, that access will be uninterrupted, that there will be no delays, failures, errors or omissions or loss of transmitted information, that no viruses or other contaminating or destructive properties will be transmitted or that no damage will occur to your computer system. You have sole responsibility for adequate protection and back up of data and/or equipment and for undertaking reasonable and appropriate precautions to scan for computer viruses or other destructive properties.

14. Intellectual Property

Unless otherwise agreed, the trademarks, logos, photographs, graphics, videos and texts included on the Be Smart In Paris Website are the intellectual property of Be Smart In Paris and may not be reproduced, used or represented by third parties without the express authorization of Be Smart In Paris or they will be prosecuted. You are specifically prohibited from modifying, copying, reproducing, downloading, distributing, transmitting, commercially exploiting and/or distributing in any manner whatsoever the services, pages from the www.besmartinparis.com website. The trademark Be Smart In Paris may not be used, including as part of trademarks and/or as part of domain names, in connection with any product or service in any manner that is likely to cause confusion and may not be copied, imitated, or used, in whole or in part, without the prior written permission of Be Smart In Paris.

15. Dispute resolution

These terms and conditions shall be governed, interpreted and applied according to French law, and will be used in the case of any dispute or claim arising from the meaning of any term or these terms and conditions of sale and use. Subject to applicable law, the courts of the place of the registered office of Be Smart In Paris shall have exclusive jurisdiction for any claim or dispute arising from these terms and conditions including, but not limited to, their interpretation, validity, execution, termination and/or the consequences.

All disputes arising out of or in connection with this present agreement (including with respect to the interpretation thereof) shall be referred to the Courts of First Instance or the Commercial Courts of Paris, France which shall be competent to hear all disputes falling within their respective jurisdictions, regardless of the nationality of the litigants. This agreement has been drafted so as to comply, in particular, with Articles R 132-1 and 132-2 of the Consumer Protection Code on the protection of consumers against the use of onerous clauses.
